The Affidavit Used As the ONLY Evidence To Take My Daughter Away From Me

COMES NOW the undersigned, Protection and Safety Worker for the Nebraska Health and Human Services System defined by the State of Nebraska and being first duly sworn upon oath, deposes and states as follows:
1. I Jessyca Vandercoy Protection and Safety Worker in the Initial Assesment unit was assigned to this case on July 8, 2004.
2.On July 9, 2004 this worker accompanied by Protection and Safety Worker, Brooke Eggert conducted an unannounced home visit to Cathi de Beaulieux’s home at XXXX XXXXX XX XXXXXX Omaha NE. Minor child, Deirdre Nelson answered the front door at 3:35p.m. Deirdre was wearing only a Pull-Up diaper which was soaked with urine. Deirdre appeared disheaveled with dirty skin and matted hair. This worker observed Deirdre unattended for twenty minutes. Deirdre ran through the yard laughing.
3. At 3:55p.m. Deirdre’s maternal grandmother, Carol Nelson came to the door. This worker identified herself to Carol. This worker observed Carol yelling at Deirdre to come inside. This worker then observed Carol grab Deirdre by the upper arm, lifting Deirdre from he ground and proceeding to carry Deirdre into the house by her arm.
4. Deirdre came running outside approximately twenty seconds after her grandmother had taken her into the house. Cathi Cathleen de Beaulieux chased Deirdre through the front yard. This worker identified herself to Cathi and requested to talk regarding a referal that had come in to the CPS hotline. Cathi asked "Do you have a ?" When this worker answered "No, but your cooperation is very important" Cathi stated "you can’t come in unless you have a warrant.
5. This worker telephoned the Omaha Police Department for assistance checking on the immediate safety of Deirdre.
6. Cathi answered the door to the Omaha Police allowing the police and workers to enter her home. This worker observed the carpet to be filthy. There were ashes and food particles all over the house. This worker observed two wet used diapers on the floor. This worker observe the bedroom which Deirdre and Cathi shared to be absolutely filthy. There was no sheets on the bed, rooten food, several empty pop cans, glasses of half empty drinks ashes on the bed, soiled toddler underwear and piles of clothing, electronics and spilled makeup.
7.This worker observed full bottles of medications in Cathi’s purse on the floor. When asked why Cathi would leave medications in Deirdre’s reach Cathi stated "Deirdre doesn’t get into my purse". Cathi then reported she takes nine medications including but not limmited to, Oxycotten, Depekote, Insulin and Lithium.
8. On this date Cathi appeared lathargic and she did not speak clearly. She had difficulty following the conversation and was slow to respond to questioning. Cathi reports she has a bad back and has to lay down frequently.
9. This worker asked Cathi if she would be willing to cooperate with family support services to help her gain parenting skills, get independent housing, and get the house cleaned up.Cathi was very eager to cooperate with these services
10. This worker made a referal for family support services July 12, 2004. A family support has been working with this family for the past 8 weeks 3-4 times a week. Family Support Worker documentation reports that there is a lack of compliance by Cathi and progress has not been made. FSW reports indicate that Deirdre is filthy during visits. Cathi reports that she can not give Deirdre a bath because she has a bad back. FSW reports state that Deirdire is often left unattended while Cathi sleeps.
11. FSW reports state the home is infested with mice and roaches and Cathi is not cooperative with cleaning the home or making efforts to work on FSW goals.
10.On August 30, 2004 a seconed referal came into the CPS hotline. The reported observed red marks on Deirdre’s butt. This worker conducted an unannounced home visit on September 2, 2004. This worker observed several red marks on Deirdre’s legs and arms. Cathi stated that the red marks are from make-up Deirdre had got into while unattended. Family Support Worker documentation reports that Deirdre had told the FSW that she had red marks on her butt because her mom had spnaked her earlier in the day.
That there was no appropriate person for the undersigned to release said child to which could provide for said child’s safety and stability;
That in the opinion of the undersigned, that placement of said child into temporary foster care was a matter of immediate and urgent necessity for the protection and safety of said child and that this situation presented a safety issue to the child and precluded reasonable efforts to allow said child to remain in the parental/custodial home.

Another note: This was faxed, along with the appropriate court orders and such, to the Douglas County Sheriffs Office at 16:55, Friday, September 17, 2004. In other words, about five minutes before end-of-business on a Friday evening.
